Definitions
- Kmedia DOOH: Refers to the platform and services provided by Kmedia for managing and delivering DOOH advertising.
- User: Any individual, business, or entity utilizing Kmedia DOOH for placing and managing ads.
- Ad Content: Refers to any advertisement materials submitted by the User for display through the Kmedia DOOH network.
Ad Placement and Content
- Kmedia DOOH reserves the right to review, approve, or reject all ad content before it is displayed on its network.
- Users must ensure that their ad content adheres to applicable legal and regulatory standards, including local, state, and national advertising laws.
- Any content deemed inappropriate, offensive, or non-compliant with our content guidelines will be rejected or removed. Kmedia holds final authority in deciding what is acceptable for display.
Ad Scheduling and Display
- Kmedia DOOH provides scheduling tools for users to manage the timing and frequency of their ads on the network.
- Ad placement and display timing are subject to availability and may vary based on the terms outlined in the specific advertising agreement.
- Kmedia DOOH is not liable for any delays in ad display due to technical or external issues.
Billing and Payments
- Users agree to pay all fees associated with DOOH services according to the pricing and terms in the signed agreement.
- Payment must be made on or before the due date, and Kmedia DOOH reserves the right to suspend or terminate services for any delay or non-payment.
- No refunds will be provided once the campaign has started unless there are exceptional circumstances like technical failures from Kmedia's side. Please refer to the Refund Policy for more details.
Technical Requirements
- Users are responsible for ensuring that submitted ad content complies with Kmedia’s technical requirements, including but not limited to file formats, resolution, and aspect ratio.
- Kmedia DOOH is not responsible for poor ad display or technical issues resulting from incorrect file formats, non-compliance, or user error.
Compliance with Laws
- Users must ensure that their ads comply with all applicable laws, industry standards, and government regulations, particularly in India.
- Kmedia reserves the right to remove any ad that violates such laws or standards without prior notice.
Termination
Kmedia DOOH reserves the right to suspend or terminate any user for violating these terms or for non-compliance with any legal, technical, or financial obligations.
Force Majeure
Kmedia DOOH shall not be held responsible for delays, interruptions, or failure in service due to events outside our control (including but not limited to natural disasters, strikes, or governmental actions). Any requests for refunds under such circumstances will be evaluated on a case-by-case basis.
Governing Law
These terms are governed by and construed in accordance with the laws of India, specifically concerning DOOH advertising regulations. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.
Changes to Terms
Kmedia DOOH reserves the right to update or modify these terms and conditions at any time. Users will be notified of significant changes. Continued use of our services after such updates constitutes acceptance of the modified terms.
